Access to Medical Records

The General Data Protection Regulation gives living individuals the right to request access to personal data held on them by organisations such as the Health Board. This is known as a Subject Access Request (SAR) and is a written request made by or on behalf of an individual.

The Access to Health Records Act 1990 allows certain individuals to request access to a deceased patient’s health record and applies only to records created or updated since 1st November 1991. These individuals are defined under the Act as “the patient’s personal representative and any person who may have a claim arising out of the patient’s death”. A personal representative is the Executor or Administrator of the deceased person’s estate.
